WHAT DOES ACS DO WHEN THEY FIND SOMEONE REPORTED A FALSE CHILD ABUSE CLAIM- NOTHING

To falsely report a crime or event to a public entity is a crime in New York State. See Penal law 240.50(4). ACS receives thousands of calls a day about suspected child abuse in New York City. Many of them are demonstrably false. In fact in once case, our client's accuser told the ACS worker that she lied and would continue to make false calls. So what does ACS do about these false reports? The answer is absolutely nothing. ACS has one agenda- to accuse as many parents of child abuse and keep their funding and make it appear as they are protecting children. They fail at every step. The children who are in real need are ignored and good parents are attacked in order to  pad the ACS statistics. The names of the dead children still haunt us today. THE ACS HOME INVASION

Its 2 am and your doorbell rings. You look outside and you see uniformed police officers, You have no idea what this could be. This is actually a ACS home visit. That is correct. ACS had an emergency unit called ECS that visits families at all times of night. But recently one of our clients received one of these visits after we had gone to court and there was absolutely no emergency. The reason for the search was to make sure my client's husband was not in the home. So ACS will wake up children at 2am with police officers and call this child protection. ACS divides their cases into two very separate groups. The first group is the ACS investigation cases. These are cases where no court action has been taken yet and ACS is simply "investigating" the parents. This is where true lawlessness occurs. What the workers skillfully avoid telling parents is that everything that has occurred during this phase will be used against them in court. HOW TO FIGHT A CHILD ABUSE INDICATION BY ACS

ACS receives thousands of calls a day about child abuse. IN many cases, they will forward the case to the New York Office of Children and Family Services for a hearing. This is a two step process. First, there is a conference. At the conference an ACS attorney will tell the judge about the case against you and how they would like to proceed. The second step is an actual hearing. There are many jobs that you cannot hold if you have an ACS indication. Such as, nurse, child care, elderly care, nursing home. Thus, an indication can have a real impact on the future of any parent. It is imperative that you have an attorney present with you. Without legal help, the ACS lawyers will dictate the terms and may demand that you plead guilty. DO NOT plead guilty. HOW ACS ABUSES THE COURT SYSTEM

This is a common question from frustrated parents. The truth is that, in the hierarchy of courts, Family Court is seen as the lowest one nu prospective judges. Judges would much rather have the prestige of Supreme Court in Civil and Criminal cases. Another reason is that the legislature has ignored the needs of family court for a long time. There are simply not enough judges and the caseload is crushing. Just receiving a trial date can take months. HOW ACS TALKS TO YOUR CHILDREN WITHOUT YOUR PERMIISSION

The ACS worker has a very powerful tool in her arsenal. In order to obtain secrets access to your children, they will pull your child out of class in their school. This happens most often at NYC public schools. The DOE has a policy that gives ACS free reign over your children. Thus, the ACS worker will interview your child in private and ask her or him all sorts of questions. This can be very upsetting to a child who has never met the worker and has no way to defend themselves. WHAT CAN YOU DO? Once you are aware that ACS has been called on you, realize that they will go to your school. The first thing is to advise your child, not to speak to strangers. Second, you must advise the school officials in writing that you do not want anyone speaking to your child without you present. NYC DOE will not help you.

THE FRUSTRATION OF A PARENT TRYING TO FILE A COMPLAINT AGAINST AN ACS WORKER

The most amount of calls that our office receives is from parents who want to file a complaint against the ACS worker. The ACS Advocates Office website claims to help parents, they can be found here. The website actually informs parents of what they will NOT do: Once a parent contacts the office, a recorded message tells them to contact the ACS worker's supervisor. Thus, all parents get from ACS is a recording telling them to call ACS. This is the dysfunction that permeates this entire agency.
