CASE AGAINST DAYCARE DISMISSED!

he Law Offices of Michael S. Discioarro, LLC announced today the dismissal of charges against a daycare for abusing a child. The case Matter of B.C. FH#114240, the client ran a successful daycare with over one hundred happy children. A child brought an object to school and injured himself. The daycare was not aware of the object he brought in. Nevertheless, ACS and the Department of Health filed charges against the daycare. "This was such an unfair case, my client did nothing wrong," Mr. Discioarro said. In addition to the charges, the daycare had to deal with a frivolous lawsuit from the parents. Once charges are filed, the state has the power to shut down the daycare immediately. This can have a devastating impact on the community and the parents who run the daycare. Then the case must go before an administrative law judge and reopen the daycare. This process can take months and in the interim the daycare remains closed for families in need. If you have a daycare and are

WHAT HAPPENS WHEN YOU REFUSE TO OPEN THE DOOR FOR ACS WORKERS?

We receive this question from parents often. ACS workers will knock on your door and demand to be let in. If you do nit let them in, several things may happen. First, and most common, the ACS worker will return with a police officer to try to intimidate you into opening the door. This will often work as many people will not defy a police officer's request. if a parent still refuses, the ACS worker has the option of going to court and obtaining a court order. The more vindictive ACS workers will ask the judge to force the parent to bring the children to the ACS office. This application to the Court will be done without any notice to the parent. This is how ACS workers operate. They use intimidation, lies and the Courts to attack parents. WHEN WILL ACS REMOVE MY CHILD FROM ME?

This is every parent's worst nightmare. As we discussed, the first goal of ACS is to remove a child from her parents and place her into foster care. Right now approximately 8,900 children are in foster care in NYC. There are some types of cases where ACS will remove a child mush more quickly then others. Allegations of sex abuse against a child are the fastest way for ACS to remove a child. Even the most outlandish allegations will be take as truth by ACS workers.he child will be removed in an emergency proceeding which will then be heard by a judge.  The next category of cases where ACS is quick to remove a child is physical abuse. Simply the accusation is enough for a child to be removed. Do not speak to ACS workers and contact an our office at 917-519-8417. ACS OPENS UP " FAMILY CAFES" TO PUSH USELESS SERVICES ON FAMILIES AND REMOVE CHILDREN FROM THEIR PARENTS

ACS commissioner David Hansell recently announced the formation of Family Enrichment Centers to "help families in need" The Administration for Children’s Services is funding the new centers under the auspices of its newly created Division of Child and Family Well-Being. We have appropriated the necessary resources to ensure that the centers have what they need to succeed. Each contracted site will receive $450,000 a year and ACS is allocated an additional $150,000 for training, technology and other costs . At $600,00.00 a year these centers will serve as a new way to intake cases into the ACS system It will provide ACS with a softer approach to force parents into useless services that prop up the ACS budget and new opportunities to remove children from their parents and place them in foster care which is where ACS gains most of their financial windfall.  Meanwhile, ACS was fined and held in contempt for not buying a child in foster care a new wheelchair that was badly needed
