SHOULD I SIGN A HIPPA FORM FOR ACS ?

 ACS workers routinely demand that parents sign HIPPA forms so the ACS worker can obtain the children's medical records. These forms will allow the worker to obtain all of your child's medical records. Do NOT sign any HIPPA forms for ACS unless you have spoken to an attorney. The ACS worker will review these records and attempt to manufacture charges against the parent. We have seen this over and over again.  according to the government website this is the parties that are covered:


Covered Entities

The following types of individuals and organizations are subject to the Privacy Rule and considered covered entities:

  • Healthcare providers: Every healthcare provider, regardless of size of practice, who electronically transmits health information in connection with certain transactions. These transactions include claims, benefit eligibility inquiries, referral authorization requests, and other transactions for which HHS has established standards under the HIPAA Transactions Rule.
  • Health plans: Entities that provide or pay the cost of medical care. Health plans include health, dental, vision, and prescription drug insurers; health maintenance organizations (HMOs); Medicare, Medicaid, Medicare+Choice, and Medicare supplement insurers; and long-term care insurers (excluding nursing home fixed-indemnity policies). Health plans also include employer-sponsored group health plans, government- and church-sponsored health plans, and multi-employer health plans.
    • Exception: A group health plan with fewer than 50 participants that is administered solely by the employer that established and maintains the plan is not a covered entity.
  • Healthcare clearinghouses: Entities that process nonstandard information they receive from another entity into a standard (i.e., standard format or data content), or vice versa. In most instances, healthcare clearinghouses will receive individually identifiable health information only when they are providing these processing services to a health plan or healthcare provider as a business associate.
  • Business associates: A person or organization (other than a member of a covered entity’s workforce) using or disclosing individually identifiable health information to perform or provide functions, activities, or services for a covered entity. These functions, activities, or services include claims

THE ACS DRUG TEST GAME

As we have discussed, anyone with a phone can call ACS on anyone else. ACS does not investigate who calls. they simply go and attack the parent. One of the most common calls to ACS is that a parent is using "drugs". The ACS worker will then go to the home and demand that the parent take a drug test. This is a trap. The way ACS uses drug tests is as follows. If they are positive, even for marijuana, they will demand that the parent enter into a drug program. If they are negative, they will hide the results and harass the parent until the parent enters a drug program. For ACS , the accusation is the proof of the case. It is very difficult for parents to deal with them because they are so unprofessional and the parents are not prepared for this. THE STEPS OF AN ACS CASE

 In this post we will discuss in depth all of the steps of an ACS case. 1. INVESTIGATION - The case starts with a call being made to ACS or the child abuse hotline that a child is being abused or neglected. It is important to remember that anyone can call on anyone for anything. This will result in an ACS worker coming to your doorstep. This may happen at any time of the day or night.
