 This is on elf the most asked questions we receive. You can either file the lawsuit yourself or retain at n attorney to file it on your behalf. When suing an agency like ACS,  you  must be familiar with all of the legal procedures. I would advise most people to retain an attorney. Whether or not an attorney will accept your case is based on the facts of your individual ACS case. ACS workers routinely violate the rights of parents and are never held accountable in most cases. CAN I SUE ACS?

 We need to revisit this topic because it comes up so often in our practice and by desperate parents who are involved in ACS cases. To begin with, what is meant by suing ACS is filing a lawsuit against the agency, the worker, and the City of New York. In order to file a lawsuit, you should obtain an attorney. While you can file a lawsuit pro se ( without a lawyer), the laws regarding suing the City and the legal procedures are simply too complicated for a non-lawyer to be effective. Thus the first obstacle is retaining a lawyer who will take your case. This is a major hurdle. Cities and states have whats called, qualified immunity. This makes them more difficult to sue. The kind of lawyer you would need is a personal injury lawyer. This may sound strange, but these are the lawyers that routinely sue NYC in court for violating the rights of citizens. THE NEW YORK TIMES IS REPORTING THAT ACS WILL ADD 400 ACS WORKERS IN JUNE

According to this article , the NY Times reports that ACS will add 400 ACS workers in June. If true, this will simply be chaos. The article, which is a PR stunt by ACS also states that ACS is tearing away children from their parents at a higher rate than before. This is of little concern to the ACS Commissioner who simply sees it as the way ACS does business.ACS workers are very poorly trained, or not rained at al. Recently, we asked an ACS worker if she knew what the Family Court Act was and she had no idea. To add 400 new ACS workers with the power to remove children from their homes is irresponsible and will lead to more broken families. This new Commissioner is of the opinion that all you have to do is take children away from their parents and they will be fine. This is a very bad sign of things to come. HOW ACS AND FAMILY COURT JUDGES PERPETUATE INEQUALITY IN NYC

New York City has made an incredible transformation in the last 20 years. NYC is now a wealthy thriving metropolis that is the envy of the world. The top talents of any field are here.  As a result, many families are struggling financially because of skyrocketing rents. This is especially true in the black community. This is where ACS is most aggressive. ACS workers target single black mothers at an alarming rate. It has been called the new family Jim Crow. ACS workers are quick to tear apart black mothers from their children and place them into foster care and place the mother into a shelter. Many single black mothers are told, "quite your job, you can go to a shelter." This adds to the ACS statistics and allows millions of dollars to flow to ACS and the foster care system. HOW TO SUE ACS

Our office receives many calls by parents asking how they can sue ACS. This is a very complicated question. The first thing a parent  must do is to document all of the interactions that they have with an ACS worker. Second, parents must be organized and collect evidence of their innocence. Because ACS is a city agency, what is called a Notice of Claim must be filed with NYC within 90 days of the incident. This is a very complicated process. Additionally, ACS has certain legal protections because they are part of the state. In order to overcome these protections, one must retain a seasoned attorney in order to fight the case in court. The most damaging thing that a parent can do, is speak to the ACS worker. They are trained to attack the parents. Every explanation or evidence that a parent tries to provide will be used against them. It is crucially important to contact an attorney as soon as you are contacted by an ACS worker. This will be the best way to protect your rights. BR...
