  They Wanted to Foster Their Great-Grandson. Why Did New York Say No? A lawsuit challenges New York’s system of disqualifying potential foster parents because of their criminal records. The above  headline was an article win The NY Times. you can follow the link to read it. The question becomes, why does ACS disqualify families from becoming foster parents. The answer is simple. Its money. Placing a child in what is called Kinship foster care allows for less funding than in non-kinship foster care. Thus ACS is intentionally harming children for the sake of funding. There are about 9,000 children in the NYC foster care system and each one represents tens of thousands of dollars to ACS.  Our children deserve better. THE RACIAL DISPARITY IN NYC'S FOSTER CARE SYSTEM MUST BE ADDRESSED

 NYC mayor Bill Deblasio is big on "equality.'. However, in the area where it matters the most, he and ACS fail miserably. In NYC, ACS preys on black and hispanic families in order to remove their children as quickly as possible. The numbers are staggering. WHY? The answer is simple, they are easy targets for ACS workers. ACS targets low income families with limited educational resources and job opportunities. These families are forced to accept court appointed attorneys that with some exceptions, rubber stamp the removal of their children. In our 20 years of practice we have seen exactly 5 white children removed, while countless black and hispanic children have been torn from their parents. The vast majority of children in the foster care system should not be there. But, it is a huge money maker for state and local agencies like ACS. The goal of ACS is to keep the funding flowing. DO I HAVE TO OPEN THE DOOR TO AN ACS WORKER?

One of the most frightening thing that a parent will face is a knock at the door by an ACS worker. ACS workers do not have badges or guns, many don't eve carry id or business cards. They are a highly untrained and unprofessional group. However, they do have the power of the state behind them. Once an ACS worker receives a case they must, by their own regulations, see the child within 24 hours. This is something they take very seriously. They want to see the child as soon as possible. So what should you do? If you refuse to open the door, the ACS worker will return with the police to try and intimidate you into opening the door. If that fails, the ACS worker will go to court and ask a judge for a warrant. Because of the vindictiveness of how ACS workers operate, they will ask a judge to order you to bring the child to ACS offices within a specified period of time. WHY ACS REMOVES CHILDREN FROM FOSTER PARENTS AND PLACES THEM WITH OTHERS

We receive many calls from NYC foster parents who have had their children removed from their care and placed with others. Why does this happen. The answer is very simple: money. ACS receives more funding when they can remove children from one foster home to another. More money from the federal and state governments and more people being paid to finish the transaction. As we have discusses, the main focus of ACS is to keep their $3.1 billion budget. Thus, they must attack and manufacture cases against every parent that they come into contact with. CAN ACS TAKE MY CHILD?

This is the ultimate question we receive from parents. ACS has the power to remove a child in an " emergency" under the Family Court Act. ACS can also ask a judge to remove a child from a parent during the pendency of a case. Some of the major reasons that ACS would remove a child are: - sexual abuse - excessive corporal punishment - alcohol or drug abuse by parent - disobeying court order Once a child has been removed from a parent they can either go into the care of a relative, known as kinship care, or into the foster care system. The foster care system in New York City is rife with abuse and neglect and is expressly poorly managed. It is one of the major failures of ACS. While their are many well-meaning foster care parents, ACS is highly dysfunctional in supporting them. This has been a problem for decades and ACS refuses to fix the issues in the foster care system.
