WHEN AN ACS WORKER TELLS PARENTS SHE WILL "CLOSE THE CASE"

One favorite tactic of an ACS worker is to state that she needs to make another visit to "close the case". Most parents breathe a sigh of relief, they believe the case is over. However,  once the ACS worker arrives, they advise the parents that their supervisor wants to close the case but needs the parents to do services. These are usually worthless parenting classes or anger management classes. The key for ACS workers is to have the parent enroll in classes so they can continue to receive funding from the state and federal government. HOW ACS AND FAMILY COURT JUDGES PERPETUATE INEQUALITY IN NYC

New York City has made an incredible transformation in the last 20 years. NYC is now a wealthy thriving metropolis that is the envy of the world. The top talents of any field are here.  As a result, many families are struggling financially because of skyrocketing rents. This is especially true in the black community. This is where ACS is most aggressive. ACS workers target single black mothers at an alarming rate. It has been called the new family Jim Crow. ACS workers are quick to tear apart black mothers from their children and place them into foster care and place the mother into a shelter. Many single black mothers are told, "quite your job, you can go to a shelter." This adds to the ACS statistics and allows millions of dollars to flow to ACS and the foster care system. JUDGES IN FAMILY COURT IN NYC HAVE ALL OF THE POWER

The Family Court Act is the New York Law that governs Family Courts in New York state. A simple reading of this law, will show you how much power family court judges have in the state. They, and only they, decide what happens to your children. With that understanding, ACS workers and lawyers have a keen understanding of each judge and will craft their case accordingly. In criminal and civil courts, the juries have the ultimate say. There is no reason why parents do not deserve juries in Family Court to judge them if they have neglected their child We recently had one ACS lawyer tell us that Family Court is not " punitive'. This is simply an outrageous remark. What could be more punitive than losing your child?  Family Court proceedings are hidden from the light of the public because no juries are allowed. Parents are abused by an A CS bureaucracy that is concerned only with its self-preservation. It is time for juries in Family Court ACS cases.

A VICTORY FOR A FATHER

The case was as complicated as it gets. F.S. and his soon to be ex-wife were in the process of a hotly contested divorce. She had accused him of domestic violence, had him arrested and ACS brought neglect charges against F.S. in Family Court. After a trial before the Hon. Emily Olshansky, the Court found the client did not commit child abuse. "There was a lot at stake for our client in this case. If he lost this case he would have certainly lost custody," Mr. Discioarro said. The soon to be ex-wife testified how awful and controlling F.S. was and how he was violent and abused her for years. Meanwhile, under intense cross-examination, she admitted to shoplifting, and even lying to her friends and family on Facebook as to her academic achievements. "ACS did a very poor job of investigating this case," Mr. Discioarro said. "They should have known that this woman was lying about almost everything in her life."
