THE CHILD ADVOCACY CENTER INTERVIEW AND ITS HORRORS

 ACS workers have a very powerful tool against parents in child abuse investigations. When an ACS workers interviews a child and is not given the answers that will allow him to charge the parents with child abuse, they will conduct a Child Advocacy Center interview. The process is as follows. The child is taken to a CAC center, where an "expert" interviewer will browbeat the child into admitting that the parents did something. As soon as a child says anything negative about the parent, the interview stops and the parent will be charged with child abuse. This is done to children as young as four. The interviews are recorded and presented in court. The interviewer is usually a recent college grad who has been given clear instructions to try and get "something" on the parents. To view some of these interviews is truly shocking. If a child says nothing happened he is not believed. If a child lies about various issues its put down as kid talk. The only thing that matters...

WHAT IS AN ACS ADVOCATE

During child safety conferences, ACS workers will assign a parent an "advocate". This is a person who works for ACS who's job it is to advocate for the parent. In reality, this person will advise the parent to simply cooperate with ACS and the case will beaver soon. They are there to "soften up" the parent so ACS workers can extract more information from the parent and attack them as much as they can. DO NOT SPEAK TO ACS WORKERS

 The most important thing a parent can do is not speak to an ACS worker without an attorney.Every day in our practice parents, tell us the nightmare stories that they have suffered at the hands of ACS workers. It all begins with the parent talking to an ACS worker about their family. Let us remember the two a main goals of ACS: 1. To remove children to foster care 2. To register parents in useless services that help no one. The goal of all ACS workers is to attack the parents and create a court case against them. Ironically, ACS workers only attack good parents. WHY? because they know that these parents will never harm their children. Thus, after ACS has them enrolled in useless classes and services, they can claim that they have "fixed" a family.  Now  children in crisis are very difficult to help that is why so many children who need real help die while they are under ACS supervision. WHY COMPLAINTS ABOUT ACS GO NOWHERE

 We are often asked, who parents can g complain to about ACS and especially ACS workers. The real answer is, no one. ACS is an agency that is beyond being shamed or attacked or punished in any way. It is an agency that has failure as its hallmark. This is an agency that has, through its incompetence, allowed children to die in unsafe homes, yet at the same time attacking innocent parents. In fact, when ACS allows a child to die, the mayor and commissioner hold a press conference stating how this should never have happened and how ACS will obtain moire training and money. The ACS budget is now over 3 billions dollars. And no one has any idea how this money is spent. In fact, a judge in Manhattan recently held ACS in contempt for not buying a handicapped child a new wheelchair. This is child abuse in its worst way. HOW TO WIN A 1028 HEARING AGAINST ACS

The Family Court Act section 1028 allows parents to have a hearing if their children have been removed by ACS or in many cases if the parent has been excluded from the home. In the vast majority of cases, the Court must begin the hearing within three days. Here is the catch, the Court does not have any time frame in which it must conclude the hearing.  Family Court judges in NYC are swamped to say the least. The demands on their time are severe and ultimately parents and children suffer. So how does one actually win a 1028 hearing? To begin with, the burden is on ACS to show that the parent is an imminent risk. Imminent does not mean possible. The risk must be real and lurking. Each case is unique but here are some things you must do: - Bring witnesses if any - Be prepared to testify on your own behalf. -Use ACS tactics against them. - Read all of the progress notes in the case. STATEN ISLAND ACS OFFICE ANNOUNCES NEW PROTOCOLS

The city Administration for Children's Services (ACS) announced a new heightened protocol for critical and serious child abuse investigations. The new protocol ensures a review of any maltreated child, who is three years old or younger, and there is a fatality report or a report filed that alleges serious injury and/or sexual abuse. ACS Commissioner David A. Hansell announced the new Heightened Oversight Protocol (HOP), which is a two-step process combining the expertise of ACS' investigative consultant supervisors -- who are retired NYPD detective supervisors and ACS' child protective specialists. "Protecting children is the core of our mission," said Hansell. "This new, heightened protocol will bring more investigative expertise into our highest-risk cases throughout the course of the investigation." ACS GETS $3 BILLION BUDGET IN 2018, AND THE DYSFUNCTION CONTINUES

Fiscal 2018 Preliminary Budget Highlights The City’s Preliminary Fiscal 201 8 Budget is $84.7 billion, $2.6 billion more than the Fiscal 2017 Adopted Budget of $82.1 billion. The Fiscal 2018 Preliminary Budget includes $61.6 billion in City tax-levy funding and $23.1 billion in non-City funds. The Administration for Children’s Services (ACS) Fiscal 2018 Preliminary Budget totals $3.03 billion (including City and non-City funds); this represents approximately 3.5 percent of the City’s total Budget. ACS’ Fiscal 2018 Preliminary Budget is $55.6 million more than the Fiscal 2017 Adopted Budget of $2.97 billion. *The difference of Fiscal 2017 Adopted Budget compared to Fiscal 2018 Preliminary Budget.
