One of the most frightening thing that a parent will face is a knock at the door by an ACS worker. ACS workers do not have badges or guns, many don't eve carry id or business cards. They are a highly untrained and unprofessional group. However, they do have the power of the state behind them. Once an ACS worker receives a case they must, by their own regulations, see the child within 24 hours. This is something they take very seriously. They want to see the child as soon as possible. So what should you do? If you refuse to open the door, the ACS worker will return with the police to try and intimidate you into opening the door. If that fails, the ACS worker will go to court and ask a judge for a warrant. HOW CAN WE FIX ACS?

Last winter, Governor Andrew Cuomo engaged Kroll Associates—a premier white-collar investigative firm, renowned for high-stakes snooping in the corporate world—to suggest how to fix the city’s broken child-welfare system. The consultants produced a 31-page report of practical recommendations, including hiring more caseworkers to reduce caseloads, hiring investigators with law-enforcement backgrounds to perform criminal background checks on parents, and increasing the number of ACS staff authorized to see these criminal-history records. Kroll suggested that investigators with law-enforcement backgrounds accompany caseworkers to at-risk homes, and recommended better coordination between the ACS and the Department of Education, as well as other agencies. The consultants also urged the ACS to reduce the “response time” of caseworkers when learning of imminent danger in the home.

WHAT IS A CHILD SAFETY CONFERENCE, ACS JUST CALLED ME IN TO DO ONE

After ACS has made their initial visit, the ACS workers and supervisors have a very useful tool which they use to attack parents with. It is called a CHILD SAFETY CONFERENCE. The parents are ordered by the ACS worker to be at their office at a certain time. One they arrive the parents will be meeting with the ACS worker and her supervisor. This can be more aptly called an ambush. At this conference the ACS worker will accuse the parents of wrongdoing and demand that they enter into "services". During the process, the parents will be threatened with the removal of their children and court action. ACS workers often threaten parents with the statement " we will take this to court ". GOVERNOR CUOMO MOVES TO DEFUND USELESS ACS PROGRAM

Governor Cuomo moved to defund a useless and badly managed program run by ACS to manage juvenile delinquents. There have been hundreds of escapes and the program replay highlights the incompetence that has become the hallmark of ACS. At each step of the child protection process, ACS fails. They fail the children who are really in need and they attack good parents who have done nothing wrong. However, ACS is never held accountable. ACS workers are rarely fired and the Mayor keeps bringing in one commissioner after another to appear as of he is doing something. HOW ACS ABUSES THE COURT SYSTEM

This is a common question from frustrated parents. The truth is that, in the hierarchy of courts, Family Court is seen as the lowest one nu prospective judges. Judges would much rather have the prestige of Supreme Court in Civil and Criminal cases. Another reason is that the legislature has ignored the needs of family court for a long time. There are simply not enough judges and the caseload is crushing. Just receiving a trial date can take months. HOW ACS TALKS TO YOUR CHILDREN WITHOUT YOUR PERMIISSION

The ACS worker has a very powerful tool in her arsenal. In order to obtain secrets access to your children, they will pull your child out of class in their school. This happens most often at NYC public schools. The DOE has a policy that gives ACS free reign over your children. Thus, the ACS worker will interview your child in private and ask her or him all sorts of questions. This can be very upsetting to a child who has never met the worker and has no way to defend themselves. WHAT CAN YOU DO? Once you are aware that ACS has been called on you, realize that they will go to your school. The first thing is to advise your child, not to speak to strangers. Second, you must advise the school officials in writing that you do not want anyone speaking to your child without you present. NYC DOE will not help you.
