They may also use language like "you don''t need a lawyer". This is simply untrue. The right to counsel in New York is heavily protected by the courts. ACS workers despise dealing with attorneys and in fact ACS policy is that ACS workers do not speak to attorneys. ACS workers will only speak to parents. What is the reason for this policy? Government agents of all types speak to attorneys on a regular basis to resolve cases. ACS workers are very poorly trained and the vast majority have not been on the job very long. ACS divides their cases into two very separate groups. The first group is the ACS investigation cases. These are cases where no court action has been taken yet and ACS is simply "investigating" the parents. This is where true lawlessness occurs. The ACS workers are fond of telling parents " you don't need a lawyer, this is not a court case". What the workers skillfully avoid telling parents is that everything that has occurred during this phase will be used against them in court. Elijah was a student at the Seventh Avenue Center for Family Services in Harlem, a program overseen by the city’s Administration for Children’s Services and the Health Department. The Health Department said it has closed the school on Wednesday for inadequate supervision of a child and for failing to follow its own written safety plan. The site also houses a Universal pre-K program, part of Mayor de Blasio’s effort to provide free prekindergarten to all New York City 4 year olds, but Elijah was not a UPK student....

This is a common complaint we hear from parents when they call us for help. They do not believe that the free court appointed lawyer is helping them. Indeed there are some structural problems with the attorneys that the court appoints to represent parents for free. First, these lawyers are often good lawyers but are overwhelmed by the amount of cases that they have to handle. ACS workers are quick to tear apart black mothers from their children and place them into foster care and place the mother into a shelter. ACS workers like to bully parents into attending what they call a Family Safety Conference. Attorneys who represent these parents are not allowed as per ACS policy. So, in a society where the right to counsel is omnipresent, ACS is so fearful of being exposed that they try to hide what they do from as many people as possible. As an attorney I have met with the FBI, NYPD, DEA, DOI and dozens of other state, federal and city agencies on behalf of clients. However, ACS workers have devised a system where they want to abuse parents in private without the benefit of an attorney to guide them. The Family Safety Conference is simply an ambush conducted by the A CS worker and their supervisors where they accuse the parents of wrongdoing and then demand that parents follow the ACS orders.
