THE ACS CHILDREN'S CENTER ALLOWS CHILDREN TO WANDER THE STREETS WITH NO CURFEW OR SUPERVISION

  In a recent case, we were informed that a 14 year old girl who ACS has placed at the ACS Children's Center in Manhattan, has no supervision and is allowed to wander the streets until late into the night. When confronted, a high ranking ACS official advised us that " no force is used to force children to stay. they must want to stay." Thus children can come and go as they please and ACS offers no help for parents looking for supervision. This is the type of policy that is destroying families in the ACS system. If a parent allowed their 14 year old child to stay out all night and consume alcohol and do drugs, they would be charged with neglect. ACS is failing our children. WHAT IS THE ACS INVESTIGATION PROCESS?

 This is a common question and often never clearly answered by ACS. This is the official ACS statement on what ACS does during an investigation: During the investigation, ACS will: Contact the person who made the report within 24 hours, to gather more information. Make an unannounced visit to your home within 24 – 48 hours of the report. CPS must see and speak to all your biological children living with you or with other caretakers, as well as all children that are present in the home during the investigation. Speak to all adults or caretakers living in the home. Give you a letter called a Notice of Existence, informing you that you have an open investigation of abuse or maltreatment. If you are not home, CPS will leave a Notice of Home Visit letter informing you of the visit. The answer is wherever the ACS worker decides. Upon first meeting the parents, the ACS worker will pry and ask as many questions as possible about the family as possible. This will help them reach their goal of demanding that parents attend classes and training. The favorite topic of ACS workers is when they can allege that there has been domestic violence in front of the children. The worker will then manufacture a case of abuse against the parents. YOU CAN'T HAVE A LAWYER IN THIS CASE  ACS workers who visit parents at the home will often advise parents that they are not allowed a lawyer because the case is not in court. They may also use language like "you don''t need a lawyer". This is simply untrue. The right to counsel in New York is heavily protected by the courts. HOW CAN WE FIX ACS?

Last winter, Governor Andrew Cuomo engaged Kroll Associates—a premier white-collar investigative firm, renowned for high-stakes snooping in the corporate world—to suggest how to fix the city’s broken child-welfare system. The consultants produced a 31-page report of practical recommendations, including hiring more caseworkers to reduce caseloads, hiring investigators with law-enforcement backgrounds to perform criminal background checks on parents, and increasing the number of ACS staff authorized to see these criminal-history records. Kroll suggested that investigators with law-enforcement backgrounds accompany caseworkers to at-risk homes, and recommended better coordination between the ACS and the Department of Education, as well as other agencies. The consultants also urged the ACS to reduce the “response time” of caseworkers when learning of imminent danger in the home.

FAMILY COURT ACT 1034 ACTIONS BY ACS

ACS workers will often demand to speak to the children alone outside the presence of the parents. This is a common request by aggressive ACS workers. If a parent does not comply, the ACS worker will go to court and ask a judge for an order directing the parents to do so. Unfortunately, we are seeing this tactic more and more. It is also true that the vast majority of Family Court judges will rubber stamp most ACS requests. It is difficult to find a truly independent Family Court judge. ACS WANTS TO SPEAK TO MY CHILD ALONE

One of the biggest complaints we hear from parents is that the ACS worker barged into their home and demanded to speak to they child outside the presence of the parent. Governor Cuomo moved to defund a useless and badly managed program run by ACS to manage juvenile delinquents. There have been hundreds of escapes and the program replay highlights the incompetence that has become the hallmark of ACS. At each step of the child protection process, ACS fails. They fail the children who are really in need and they attack good parents who have done nothing wrong. However, ACS is never held accountable. ACS workers are rarely fired and the Mayor keeps bringing in one commissioner after another to appear as of he is doing something. THE ACS INVESTIGATION PROCESS

Parents that have dealt with ACS workers tell horrific tales. How does ACS conduct an investigation?First, the ACS worker will appear on your doorstep without an warning or advance notice. Second they usually do not show id or provide business cards to parents because they do not want to be identified. They will then tell the parent that someone called and ACS has concerns. Any anonymous phone call to ACS will start an investigation. The worker will not tell the parent the exact charges but will only state that ACS has concerns. The ACS worker will then try to speak to your children alone. The most important part of the investigation and what ACS workers are fearful of doing, is recording the interviews in any way.
