WHAT ARE THE PARENT'S RIGHTS IN AN ACS CASE?

 ACS has a website dedicated to what happens to parents in an ACS case. You can find it here.  What ACS does not tell you is that you have legal rights that ACS cannot remove. We will discuss each one. 1. THE RIGHT TO A LAWYER - The New York and Federal constitution guarantee a right to a lawyer. CAN I RECORD AN ACS WORKER

  This is a common question that many parents have. An ACS worker comes to your door out of nowhere and demands to come in. ACS workers are very poorly trained, very aggressive and will attack parents from the beginning. What do you do? The one thing you can always legally do is to film the acs worker in your own home. The ACS worker will object vehemently and tell you in many cases that it is illegal. This is imply not true. There is no reason why you should not record the anyone from the state that comes into your home. Most ACS workers will argue and attack you for doing so. Stand your ground and stand up for your rights. Let the ACS worker know you are recording them. They will claim it violates confidentiality. THE DEVASTATING CONSEQUENCES OF SPEAKING TO AN ACS WORKER WITHOUT AN ATTORNEY

I have nothing to hide. This is what most parents believe when they receive a call from ACS. Naturally, parents will freely let the ACS worker in and discuss all sorts of family issues. WHAT DOES IT MEAN TO BE INDICATED FOR CHILD ABUSE?

It is a shock to most parents. You receive a letter in the mail from the Office of Children and Family Services, stating that you have been indicted for child abuse. What does this mean? The OCFS is an office that handles child abuse cases. If ACS does not have enough evidence against parents to bring charges against them in family court, they will bring a case in OCFS. The office does a "review" and advises the parent if they have been indicted. The vast majority of parents will be indicted by OCFS. The process then involves a hearing before an administrative law judge. These indications have serious consequences for parents who work in child care or healthcare. CAN I RECORD THE ACS WORKER?

We have always strongly advised to record the ACS worker. We advise clients to tell the ACS worker that they are being recorded. It would be best to make a video recording. The ACS worker will react in a very negative manner. They will wrongly tell the parent that it is illegal to record her and that she does not want to be recorded. New York law allows in most cases to record your own conversations. As soon as you are aware that an ACS worker is coming after your family. contact an attorney ASAP.
