HOW DO I SUE ACS?

One of the most common questions we receive is, Can I sue ACS? The answer is it depends and will you be successful? The first thing you must do is file a notice of claim. This puts the city on notice t hat you plan to sue them. You will have to doe a deposition that the city will take and try to assess your case. ACS has something called qualified immunity that means that they can get away from a lot of abuse against parents. It is vitally important to contact a civil rights lawyer if ACS removed your kids or has abused you as a parent. STATENISLANDACSLAWYER.COM MANHATTANACSLAWYER.COM

DO I HAVE TO OPEN THE DOOR TO AN ACS WORKER?

One of the most frightening thing that a parent will face is a knock at the door by an ACS worker. ACS workers do not have badges or guns, many don't eve carry id or business cards. They are a highly untrained and unprofessional group. However, they do have the power of the state behind them. Once an ACS worker receives a case they must, by their own regulations, see the child within 24 hours. This is something they take very seriously. They want to see the child as soon as possible. So what should you do? If you refuse to open the door, the ACS worker will return with the police to try and intimidate you into opening the door. If that fails, the ACS worker will go to court and ask a judge for a warrant. Because of the vindictiveness of how ACS workers operate, they will ask a judge to order you to bring the child to ACS offices within a specified period of time. As soon as you hear an ACS worker contact you, contact an attorney as soon as possible. The ACS worker will say you ...

BLACK LIVES MATTER- NOT TO ACS

In a time of unprecdentdn protest the black community is rightfully ready to engage the system at every level. However, one agency does more to damage the black family than any cop ever could. ACS routinely removes black children from their parents and terminates the rights of black parents at a higher rate then white ones. This must end! In our 20 years of observing the system close up, we have seen ACS destroy so many black families. We have tried to communicate this to the three commissioners and no one would listen. This is the time to fight ACS. FIGHTACS.COM BROOKLYNACSLAWYER.COM BROOKLYNACSATTORNEY.COM STATENISLANDACSLAWYER.COM

ACS ABUSE AND LIES

A recent cried relayed an ACS investigation that was simply horrific. ACS had been called on our client because of educational neglect. When the ACS worker arrived, she started asking about our client's entire life history. Then, the horror started. The ACS worker demeaned that our clients children be disrobed so she could check the children for bruises. Our client's 15 year old daughter was disrobed by a stranger and had to be examined. Also, the ACS worker demanded that the client take a drug test. The call was for educational neglect why was there a need to disrobe a 15 year old girl? This is a classic case of ACS abuse. ACS IN STATEN ISLAND

We will now discuss how ACS operates in each borough. They behave very differently based on the demographics and the needs of ACS. ACS in Staten Island has a smaller staff because its a less populated borough. Thus we run up against the same aggressive ACS workers. Also because Staten Island has a handful of Family Law judges, the same ACS workers are often appearing before the same judge. the ACS office is located at: 350 Saint Marks Place, 5th Fl.  (718) 720-2764 This is where children are taken and interrogated and removed from their parents. It is also the place where the child safety conferences happen. Lawyers are not allowed at child safety conferences, despite the fact that they can be used to remove children. ACS TOLD ME I HAVE TO LEAVE MY HOUSE

One of the most illegal and damaging things that ACS workers do, is when they decide that a parent must leave the home and demand that he/she leaves without a court order. ACS workers will threaten the other parent with the removal of the children if the target parent does not leave. Only a judge has the legal authority to remove a parent from the home. If ACS has demanded that you leave the home, please contact an attorney as soon as possible and stand on your rights. Call The Law Offices of Michael S. Discioarro, LLC at 917-519-8417.
