ACS pays more than $774 million for the outside agencies’ services in looking after abused, neglected and ill children. THE REASON WHY ACS ATTACKS GOOD PARENTS

We are often asked by our clients, why is ACS attacking me in this way? The answer is very simple. Because New York City has become a wealthier place in the last 20 years, many social services are simply not needed. Parents with resources are able to obtain help privately without the interference and the treat of court action. This leaves ACS is a difficult position. Like every business, they need customers to survive. The best way to do that is to attack and force services on good parents. For one simple reason. ACS knows that these parents love their children and would never harm them. Its the equivalent of the mechanic facing a car that is not broken. He can claim after the fact that he's a great mechanic. ACS forces parents into useless ACS programs and at the end of the year they write a report to the city Council outlining how many families they have "helped" and ask fro more funding. This is the political money game that ACS workers play. They are advised by their

HOW FIGHTING DAYCARE VIOLATIONS AGAINST ACS AND THE DEPARTMENT OF HEALTH CAN SAVE YOUR BUSINESS

The New York State Department of health regulates daycare centers. They along with ACS investigate allegations of violations at any licensed daycare center. Thes two agencies start with the position that any violation is cause to shut down the daycare. They also both attempt to hold daycares to impossible standards and will use these unfair standards to attack the daycare owner. The DOH will also place your daycare on their website so parents can review the violations. This can be found here.  These are also credentialed programs. What are Credential Programs? Credentials are academic degrees, licenses or certificates awarded to individuals who successfully complete state or national requirements to enter specialized roles in the early childhood profession. There are many programs that offer credentials that have been established to improve the competencies of people working with children and their families. Some include: Child Development Associate Credential  is the most widely rec

HOW ACS WORKS TO HAVE PARENTS LOSE THEIR JOBS

If a parent is accused of child abuse, certain jobs will refuse too hire them. This is especially true of parents in the medical and child care and mental health fields. Thus, while they claim that they are there to protect children, they are putting parents in a position to not obtain employment and not be able to feed their children. This is who ACS is . Our children deserve better. FIGHTACS.COM BROOKLYNACSLAWYER.COM

DO I HAVE TO TAKE AN ACS DRUG TEST?

This is one of the favorite actives of ACS workers. An anonymous call comes in and accuses parents of using drugs. The ACS worker will then barge into the home and demand that both parents take drug tests or they will be "taken to court'. The threat of Court action and removal of the children is a hammer ACS workers are very ready to use. The goal into have the parents be in fear and comply with ACS demands. ACS workers have very limited legal authority under the Family Court Act. The ACS drug test is a weapon that is used against parents, even in cases where marijuana is alleged which is now legal in New York. If an ACS worker has demanded that you take a drug test, call The Law Offices of Michael S. Discioarro, LLC at 917-519-8417 and let us protect your rights. THIS IS WHAT HAPPENS WHEN YOU FILE A COMPLAINT AGAINST AN ACS WORKER

Parents often ask, how do I file a complaint against and ACS worker? ACS workers are heavily controlled by their supervisors. There is a big degree of turnover for ACS workers, so in many cases, parents are dealing with a worker who is highly inexperienced and not trained in any way. Thus, the supervisors are where the real power lies. The supervisors are trained to fulfill the two goals of ACS. One, if possible, remove the child from the parents and if not possible, force the family into useless ACS services. This allows ACS to maintain their billion dollar funding and claim that they have helped families. The reality is ACS has very little positive impact on families in NYC. Most ion their time is spent attacking parents and destroying family bonds.  In a very clever move, Acs has set up an office called The Office Advocacy. This is the claim that is made on the ACS website: Contact the Office of Advocacy If you need assistance, please contact the Office of Advocacy. Currently, due

ACS DOESN'T HIRE PEOPLE WHO CRITICIZE THE SYSTEM

"It was rational for [the New York City's Administration for Children's Services] to be concerned about the potential disruptiveness of the petitioner's speech" put forward in his essay, wrote the Appellate Division, First Department. By Jason Grant | November 24, 2021     Appellate Division, First Department at 27 Madison Ave. (Photo by David Handschuh/NYLJ) A state appeals court has ruled it was not a First Amendment violation, or arbitrary and capricious, for New York City’s child welfare agency to avoid hiring a man in part because he’d published an essay that laid out his views on the fundamental unfairness of the criminal justice system. “The record supports [the Administration for Children's Services] assertion that it declined to hire petitioner because of its concern for the potential impact of his speech on his work, and not in retaliation for the content of that speech,” wrote a panel of Appellate Division, First Department justices, in part, as t

HOW ACS USES THE FOSTER CARE SYSTEM TO INCREASE ITS BUDGET

They Wanted to Foster Their Great-Grandson. Why Did New York Say No? A lawsuit challenges New York’s system of disqualifying potential foster parents because of their criminal records. The above  headline was an article win The NY Times. you can follow the link to read it. The question becomes, why does ACS disqualify families from becoming foster parents. The answer is simple. Its money. Placing a child in what is called Kinship foster care allows for less funding than in non-kinship foster care. Thus ACS is intentionally harming children for the sake of funding. There are about 9,000 children in the NYC foster care system and each one represents tens of thousands of dollars to ACS.  Our children deserve better. WHY DOES ACS LIE ABOUT PARENTS AND FALSELY ACCUSES THEM?

This is a common question that we receive. At the very basic level, ACS is a multi billion dollar agency that needs to prove its worth. If there are no customers, no business can survive. Thus, ACS workers arena the hunt every day for new parents to attack and force into programs or remove their child. Once a child has been removed from a parents, thousands of dollars begin to flow into the ACS coffers. This allows the agency to justify its existence. What can parents do? The main way to protect yourself is NOT to speak to ACS workers without an attorney. If an ACS worker contact you call us at 917-519-8417. NYC COUNCIL ACTS TO HOLD ACS MORE ACCOUNTABLE

Council Votes to Hold ACS More Accountable and Better Help Families Dealing with the Agency October 21, 2021 The Council will also vote to help newsstand operators survive City Hall, NY  – Removing a child from his or her home is a last resort but too often the Administration for Children’s Services relies on emergency removals, which allow the agency to remove a child without going through family court. The Council is voting on a legislative package designed to better report on these emergency removals, better inform parents of their rights and hold the agency more accountable. The first bill requires ACS to provide parents and/or caretakers with written information about their right to request a fair hearing to challenge a report made against them during an ACS child protective investigation. The Council will also vote on a bill that requires ACS to report on the total number of emergency removals of children each quarter, providing information disaggregated by race, community di

THE NY TIMES DOCUMENTS THE FAILURES OF ACS

Doctors never examined 4-year-old Jayce Eubanks’s cuts and bruises. Child welfare workers did not alert the police to 7-year-old Julissia Batties’s black eye. Investigators closed Aisyn Emerson-Gonzalez’s case despite his swollen eye and a lump on his head. All three children were beaten to death at home in the closing weeks of this summer, Their deaths were among a string of fatalities involving children who were the subject of warnings to child welfare authorities or the police in New York City. While the number of homicides of children in the city this year is close to that of recent years, the series of killings has exposed the holes in a multiagency safety net, from social workers to detectives, where a wrong decision could mean the death of a child. In recent weeks, city officials have examined how investigators skipped steps, were slow to follow up or might have closed an abuse case too soon. Several children died even after their cases had been escalated to the city’s “Instan
